User Agreement

Effective Date: February 26, 2026

This web page represents a binding legal document and is the Terms and Conditions (hereinafter referred to as "Agreement"). By accessing, registering, or using DesiSpark (the "Platform"), you acknowledge that you have read, understood, and agree to be fully bound by these terms.

1. Acceptance of Terms

By connecting to our random video chat service, you accept and agree to be bound by the terms and provisions of this Agreement. If you do not agree to these terms, you must immediately disconnect and cease use of the Platform.

2. Eligibility and Age Requirements

You must be at least eighteen (18) years of age (or the age of legal majority in your jurisdiction) to use DesiSpark. The Platform is strictly not intended for children. By using the service, you represent and warrant that you meet this age requirement. If we discover you are underage, your access will be permanently terminated without notice.

3. The Nature of Anonymous Chat & Assumption of Risk

DesiSpark connects you with completely random, anonymous users from around the world. Because of the live, peer-to-peer nature of the service, we cannot entirely control the content broadcasted by other users. By using the Platform, you acknowledge that:

• You may be exposed to content that is offensive, indecent, or objectionable, despite our moderation efforts.
• You interact with strangers at your own sole risk.
• DesiSpark does not conduct criminal background checks or verify the identities of its users.
• You are solely responsible for protecting your personal information. Never share your real name, address, financial details, or contact information with strangers.

4. User Conduct and Prohibited Activities

You agree to use the service only for lawful purposes. You agree NOT to use DesiSpark to:

• Broadcast explicit, nude, sexually suggestive, or pornographic material.
• Engage in harassment, bullying, intimidation, or hate speech against any individual or group.
• Screen record, screenshot, broadcast, or distribute the video/audio feed of any other user without their explicit, prior consent.
• Promote, distribute, or facilitate child sexual abuse material (CSAM). Violations of this nature are immediately reported to international law enforcement authorities (NCMEC, Interpol) along with your IP address and connection logs.
• Use automated bots, scripts, or virtual cameras to bypass our system, spam users, or fake camera presence.
• Attempt to hack, reverse-engineer, or disrupt the WebRTC signaling servers or peer-to-peer connections.

5. AI Moderation, Monitoring, and Privacy

While DesiSpark values user privacy and utilizes peer-to-peer (P2P) connections where possible, we employ automated Artificial Intelligence (AI) moderation tools to maintain community safety. By using the Platform, you consent to the following:

• Automated systems may take intermittent screenshots of your video feed to analyze for nudity, underage users, and terms of service violations.
• Moderators may intercept and review live video feeds or text chats if an account is flagged by our AI or reported by another user.
• If you are banned for violating this Agreement, your IP address, device fingerprints, and violation evidence may be retained to enforce the ban and protect the community.

6. Account Termination and Network Bans

DesiSpark reserves the right, at its sole discretion, to suspend, ban, or terminate your access to the Platform at any time, for any reason, without notice or liability. If your network IP is banned due to severe violations (such as broadcasting explicit content), you are strictly prohibited from attempting to bypass the ban using VPNs or proxy servers.

7. Disclaimer of Warranties

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. DesiSpark makes no representations or warranties of any kind, express or implied, as to the operation of the service, the accuracy of the matchmaking, or the uninterrupted availability of the video streams. We do not guarantee that the service will be safe, secure, or free from bugs or dropped connections.

8. Limitation of Liability

To the maximum extent permitted by applicable law, DesiSpark, its developers, administrators, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or personal safety resulting from your use of, or inability to use, the anonymous video chat service.

9. Changes to this Agreement

We reserve the right to modify these terms at any time. Any changes will be effective immediately upon posting to this page. Your continued use of DesiSpark following the posting of revised terms means that you accept and agree to the changes.
